Interesting indeed... Among all these legal mumbo jumbo it would appear that if you are sensible, it should be all ok.

an interesting article. thanks for posting Geoff.

i think the combination of digital reproduction and internet distribution have made people much more paranoid about having their image taken. i was in a neighbourhood park in brooklyn recently taking photos of my friends children and a park official told me i wasn't allowed to take photos. once my friends explained the situation it was fine. the concern being that unauthorised images of children would be distributed online.

i'm always careful when photographing people in candid public situations, and prefer to ask their permission if possible, even if i don't have to. it sometimes mean i can't get a shot i want but i'd prefer someone to consent.

Once a person becomes aware of being photographed by asking their permission, it loses the element of being candid and leaps into the realm of posed. The most obvious problem with asking permission is that 99% of people will then put on a ‘smile’ but what you are really after is the ‘real’ look.

The strange thing is that when you are in another place on holiday, you tend to take photos
all over the place of people and everything else without a moment's thought. When you are
"at home", the whole experience seems somehow different.

:agree:

could not agree more, if your a tourist no one takes any notice......(even if you do stick out!)
Hence, I find getting pictures somewhat easier when on holidays then going down to the local park etc...

Great! I have always been afraid of street photography because I thought I would end up in cell or with some soccer mom suing me!

Ive found 4020 to be an invaluable resource, having the small pdf printed out and kept in my wallet, as well as using it (alongside my knowledge of contract law) to rebuff some of the worst model releases that I have ever seen!
